Terms of Service
In short: Cravings makes the ordering pages restaurants use. When you order, you’re buying from the restaurant: it makes your food, sets prices, and handles refunds. Your card is processed by Stripe and charged only when the restaurant accepts your order. Questions about an order go to the restaurant; questions about these terms go to hello@cravings.dev.
1. Who we are and who you buy from
Cravings (“Cravings”, “we”, “us”) provides online ordering pages and tools to restaurants. Each restaurant’s page shows its own name and is usually at an address like restaurant-name.cravings.dev or the restaurant’s own web address. These terms apply when you visit those pages, place an order, or create an account.
The restaurant is the seller. Your order is a purchase from the restaurant, not from Cravings. The restaurant decides its menu, prices, taxes, hours, delivery area and fees, prepares your food, and is responsible for it. Cravings is not a party to the sale and does not prepare, handle or deliver food.
2. Placing an order
- Your order is a request to the restaurant. It’s confirmed when the restaurant accepts it, and you’ll see that on your order’s page (and by email, if you asked for updates).
- The restaurant may decline an order, for example if it’s too busy or an item has run out. If no one at the restaurant accepts your order within the time the restaurant has set, it’s declined automatically so you aren’t left waiting.
- Restaurants can pause online ordering at busy times. While paused, new orders can’t be placed.
- Prices, taxes and fees are shown before you place your order. The total on your order’s page is what you pay, plus any tip you choose.
- To change or cancel an order after placing it, contact the restaurant directly. Whether it can be changed is up to the restaurant.
3. Payment, holds and refunds
- Card payments are processed by Stripe on the restaurant’s behalf. Card details go straight to Stripe; Cravings and the restaurant never see your full card number.
- When you pay by card, your bank places a hold for the total. The restaurant is charged only when it accepts your order. If the order is declined, cancelled before it’s accepted, or never completed, the hold is released. How quickly released holds disappear from your statement depends on your bank.
- If you choose to pay at pickup or to the driver, you pay the restaurant directly.
- Refunds are decided and issued by the restaurant. Refunds go back to the card you paid with. If you have a problem with an order, contact the restaurant first.
- Tips go to the restaurant, which decides how they are shared with its staff.
4. Pickup and delivery
- Ready times and delivery times are estimates from the restaurant.
- For pickup, the restaurant may ask for the pickup code shown on your order’s page.
- Deliveries are made by the restaurant’s own drivers, not by Cravings. To confirm delivery, the driver may ask for your delivery code and may take a photo of the order where it was left. The photo is kept as the restaurant’s proof of delivery.
- Please give an accurate address and phone number so the restaurant can reach you.
5. Food, allergies and menu information
Menus, descriptions, photos, ingredients and dietary labels are provided by the restaurant. Cravings does not check them. If you have an allergy or dietary need, contact the restaurant before ordering. Kitchens may handle common allergens, and the restaurant is responsible for the food it serves.
6. Accounts and rewards
- You can order as a guest or sign in with your email address. One sign-in works at every restaurant that uses Cravings. Keep access to your email secure: anyone who can read it can sign in as you.
- You can delete your account at any time from the account page on any restaurant’s ordering page. This removes your sign-in, saved details and points. Restaurants keep their records of past orders.
- Rewards points are offered by each restaurant, separately. Points have no cash value, can’t be transferred or exchanged between restaurants, and are lost if you delete your account. A restaurant can change or end its rewards program; points for a refunded or cancelled order are taken back or returned.
7. Using the service fairly
Please don’t place orders you don’t intend to collect or pay for, use someone else’s payment method without permission, interfere with or overload the service, try to access accounts or data that aren’t yours, or use the service for anything unlawful. We may limit or block access to protect restaurants, customers or the service.
8. Warranties and liability
We work to keep the service running and accurate, but it’s provided “as is” and “as available”, without warranties of any kind to the extent the law allows. We don’t guarantee that it will always be available or error-free.
To the extent the law allows, Cravings is not liable for the food, its preparation, delivery or quality (which are the restaurant’s responsibility), or for indirect or consequential losses. Our total liability to you for any claim relating to the service is limited to the greater of the amount of the order involved or US$50. Nothing in these terms limits rights you have under consumer protection law that can’t be limited by agreement.
9. Disputes and governing law
These terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict-of-law rules. If you have a concern, please contact us first at hello@cravings.dev so we can try to resolve it. Any dispute that can’t be resolved informally will be handled by the state or federal courts located in New Jersey, unless the law where you live gives you the right to bring it elsewhere.
10. Changes and contact
We may update these terms. The date at the top shows when they last changed, and the version in effect when you place an order applies to that order. If a change is significant, we’ll show a notice on ordering pages.
Questions about these terms: hello@cravings.dev. Questions about an order: contact the restaurant you ordered from. See also our Privacy Policy.
