Restaurant Agreement
In short:
- Cravings gives you an ordering page with your name on it, an orders screen, and the tools around them.
- You’re the seller. You’re responsible for your food, prices, sales tax, refunds, and your drivers.
- Card payments go to your own Stripe account. Cravings takes 1% of the food on card orders. Nothing on orders paid in person.
- Your customers are your customers. We use their information only to run the service for you.
- You can stop at any time by emailing hello@cravings.dev.
This agreement is between Cravings (“Cravings”, “we”) and the business that creates a restaurant on Cravings (“you”, the “Restaurant”). The person who accepts it confirms they are authorized to do so for the Restaurant. It applies together with our Terms of Service and Privacy Policy.
1. The service
Cravings provides: an online ordering page for your restaurant (on a cravings.dev address or your own); a dashboard for your menu, locations, orders, drivers, rewards, reports and refunds; order emails to customers; and optional connections such as Clover. We may improve, change or retire features. If a change would significantly reduce what you rely on, we’ll give you reasonable notice.
2. Your account and staff
- You’re responsible for the people you give access to (owners, managers, kitchen staff and drivers) and for what they do in the dashboard. Remove access promptly when someone leaves.
- Keep sign-in details secure and tell us at hello@cravings.dev if you think an account has been misused.
3. You’re the seller
Every order is a sale by you to your customer. You’re responsible for:
- Your food and menu: accurate names, prices, descriptions, photos, ingredients, dietary labels and allergen information; food safety; and all licenses and permits your business needs.
- Handling orders: accepting or declining them promptly, preparing them, and keeping your hours, pause settings, prep times and delivery settings accurate. Orders no one accepts in time are declined automatically under the setting you choose.
- Delivery: your drivers are your employees or contractors, not Cravings’. You’re responsible for them, their vehicles, insurance, and compliance with employment and traffic laws.
- Customer service: questions, complaints, cancellations and refunds for your orders.
4. Sales tax and other taxes
You are responsible for determining, charging, collecting, reporting and paying all taxes on your sales, including sales tax on food and on delivery fees where it applies. Cravings calculates tax on orders using the rates and settings you enter for each location; please check them, and ask your tax adviser if you’re unsure. Where a law requires Cravings itself to collect or report tax on your sales, we’ll tell you, and you agree to cooperate (for example, by providing tax registration information).
5. Payments and fees
- Card payments are processed by Stripe through your own Stripe account, under Stripe’s Connected Account Agreement, which you accept with Stripe. Money goes from customers to your Stripe account; Cravings doesn’t hold your funds. Stripe charges its own processing fees.
- Cravings’ fee is 1% of the food subtotal on each card order, taken automatically by Stripe when the order is charged. There is no Cravings fee on orders paid in person. Any setup fee or other fee applies only if agreed with you in writing.
- Refunds: when you refund a card order, Cravings’ fee on the refunded part is returned with it.
- Disputes and chargebacks on card payments are handled through your Stripe account; you’re responsible for responding to them and for any amounts and fees Stripe charges for them.
- We may change our fees with at least 30 days’ notice by email or in the dashboard. Changes apply to orders after the effective date.
6. Customer information
- Your customers’ order information belongs to your business records. We process it on your behalf to run the service, as described in our Privacy Policy. We don’t sell it or use it to market other restaurants to your customers.
- You agree to use customer information only for your orders and lawful purposes, to follow applicable privacy and marketing laws, and to keep information you download (such as order reports) secure.
- Delivery drivers see customer details only while a delivery is assigned to them.
7. Your content and brand
You keep ownership of your name, logo, photos, menu text and other content. You give Cravings permission to host, display and adapt it (for example, resizing photos) to run your ordering page and the service, and you confirm you have the right to use it. You may not post content that is unlawful or infringes others’ rights.
8. Integrations
If you connect another system, such as Clover, you authorize us to exchange the information needed with it (for example, menu and stock). Your use of that system is governed by your agreement with its provider.
9. Availability and support
We aim to keep the service available and to fix problems quickly, but we don’t guarantee uninterrupted operation. Keep the Orders screen open with sound on during service. Support is by email at hello@cravings.dev.
10. Ending the agreement
- You can stop using Cravings at any time. To close your restaurant’s account, email hello@cravings.dev. Orders already accepted should still be completed or refunded.
- We may suspend or end your use of Cravings with notice, or immediately if you seriously or repeatedly break this agreement, if required by law, or to protect customers or the service.
- After closing, we’ll keep order records as long as the law requires and may give you a copy of your orders on request. Sections 3–6, 11 and 12 continue after this agreement ends.
11. Warranties, liability and indemnity
The service is provided “as is”, without warranties to the extent the law allows. Neither party is liable to the other for indirect or consequential losses, or lost profits. Cravings’ total liability under this agreement is limited to the fees you paid Cravings in the 12 months before the claim. You agree to cover Cravings for claims by customers or others arising from your food, deliveries, taxes, content or breach of this agreement.
12. General
This agreement is governed by the laws of the State of New Jersey, USA, and disputes go to the state or federal courts located in New Jersey. We may update this agreement; if a change affects you materially, we’ll ask you to accept the new version in the dashboard. You may not transfer this agreement without our consent; we may transfer it as part of a merger or sale of our business. If any part is unenforceable, the rest still applies.
